Man wants CJ Maraga to leave office

A man has petitioned for the removal of Chief Justice David Maraga from office over alleged gross misconduct.

Yussuf Ibrahim Dimbil says the CJ is unfit to hold office because he has made a number of mistakes.

Maraga has attended political rallies, homecoming ceremonies for politicians and on some occasions made reckless political statements without a care as to their implications to the institutional independence of the judiciary, Dimbil says. 

He believes by attending political rallies the CJ violated public trust bestowed on him.

Dimbil also claims Maraga presided over a presidential election petition without disclosing that one of the lawyers in the matter was his nephew.

“That in the presidential petition No 1 of 2017, Brian Onderi who is an advocate of the High Court of Kenya and who was on the record together with other advocates for the petitioner, is a nephew of the Chief Justice. This is critical in that, despite having full knowledge of this fact, the Chief Justice went ahead to hear and determine the petition whereas the basis of this simple fact, bias both in fact and appearance would, to any reasonable person, arise,” reads the petition in part.

The petition against the CJ comes as the Judicial Service Commission enters day two of its questioning of judges who are facing complaints.
