Justice is served! Meru sexual molester is served with life imprisonment

A 33 year old Meru man has been sentenced to life imprisonment for sexually molesting two boys in Gitoro Forest, in Meru County.

The ruling was made by Chief Magistrate Lucy Ambasi on Thursday stating that the prosecution had proved beyond reasonable doubts that Nicholas Mutuma had lured the boys, then aged three and seven, and defiled them.

The court heard how he took the boys to a nearby forest pretending to look for his donkeys which he claimed had strayed, but undressed them and sexually abused them.

Dr Winnie Mutunga, attached to the Meru Level Five Hospital testified that the boys’ anal canals were bruised.

The incident which happened on March 11, 2017 was reported after one of the boys’ mother noticed that her son was limping.

The boy recounted how Mutuma, a stone crusher, lured them to look for the donkeys, after promising to take them for swimming later on.

The boys were threatened of dire consequences if they revealed or reported the incident.

Mr Geoffrey Bor, a police officer attached to the Kambakia Police Station recounted how they rescued Mutuma from being lynched by a mob.

Ms Ambasi ruled that the prosecution led by State Counsel James Kinyua had proven all the three ingredients of defilement and case was beyond doubt.

The boys and their parents had testified that Mutuma was once their neighbour.

“He was familiar with to the minors and neither they nor their mothers or any other witness had a reason to fabricate allegations against him,” ruled Ms Ambasi.

Mutuma has been given 14 days to appeal.
