What DTB Manager Could Be Sentenced For If Found Guilty

DTB boss linked to 14 Riverside terrorist attack pleads not guilty

A Diamond Trust Bank manager who was accused for aiding terrorists of the Dussit D2 attack could suffer a sentence not exceeding 3 years in jail.

But appearing before the court on Wednesday, the manager Njoki Mbogo pleaded not guilty to charges related to the 14 Riverside attack in Nairobi.

On Wednesday morning, Sophia Njoki Mbogo was charged with three counts: failure to report suspicion of proceeds of crime, aiding and abetting terrorism and failure to report money laundering.

Mbogo has been in police custody for 30 days now before appearing in court before Milimani Chief Magistrate Francis Andayi.

Prosecution opposed to her release on cash bail and the application will be heard on Wednesday afternoon.

Mbogo is accused of allowing a huge transaction of money through her bank via the M-pesa.

However, Mbogo claimed innocence in an affidavit stating that the bank act as an agent of the mobile money transfer service.

The Constitution mandates that everyone has the responsibility to furnish the relevant agencies with information related to terrorism within their knowledge.

However, it also states that anyone who contravenes the said law, commits an offence and shall be sentenced to a jail term of not exceeding three years according to section 41, sub-section 1 and 2.

41. Duty to disclose information relating to terrorist acts, etc.

(1)A person who has any information that is relevant in—(i)preventing the commission of a terrorist act; or(ii)securing the arrest or prosecution of another person for an offence committed under this Act, shall disclose the information to a police officer.
(2)A person who contravenes subsection (1) commits an offence and is liable on conviction to imprisonment for a term not exceeding three years.

She was arraigned together with six other individuals, one of whom allegedly withdrew Ksh.9million through the same till number in different batches and then sent it to Somalia.

Al Shabaab through Qatar-based Al Jazeera had claimed responsibility for the attack at Dusit, 14 Riverside, which left over 20 people dead and some nursing injuries.
