EX Ruaraka OCS Sentenced to Death Over Murder

Former Ruaraka OCS Nahashon Mutua has been sentenced to death for killing an inmate six years ago.

“The Prosecution has proved beyond reasonable doubt that the police caused the deceased suffering while in cells which caused his death,” Lady Justice Stella Mutuku ruled on Thursday.

The High Court had found him guilty of killing Martin Koome and set Thursday, February 14, 2019 as the date for sentencing.

In December 13, 2018, the Court ruled that the element of malice aforethought had been proven.

Nahashon had denied the charges and noted that he was on duty when he received information that the inmate had been injured.

He even claimed that he is the one who directed that the man be taken to hospital.

Nine witnesses who testified on his behalf purported that the inmate had been very drunk and on evaluating his case, the OCS suggested that he be charged in court with two counts.

According to the Prosecution however, the OCS hit the inmate a number of times with a rod and forcefully submerged his head in a drum of water for about 30 minutes.

He then locked him up in the cell, even though he had sustained serious injuries.

Koome, 36, died on December 20, 2013 while undergoing treatment at the Kenyatta National Hospital.
