Politician charged with incitement and destruction of property worth Sh.7 million

A Nakuru Member County Assembly (MCA) and eight others were on Monday arraigned in court and charged with incitement to violence and malicious damage to property worth Sh. 7 million.

Peter Mbae who represents Kibanzi Ward in Nakuru County three counts of incitement to violence, malicious damage to property and arson.

He was charged that on January 30 at Solai area within Rongai sub-county in Nakuru, he incited the locals to block roads and set ablaze the Patel Farm contrary to the law.

According to the court documents, the MCA told the local residents; “go and block all the roads and set the farm on fire,” a statement that caused a breach of peace and led to unrest in the region.

During the said incident, the residents set ablaze the Patel coffee and flowers plantation with crops worth Ksh.7 million being destroyed.

The MCAalso  faced another charge of destroying windscreens of two police vehicles; one belonging to the Assistant County Commissioner and the other to the Administration Police, with the damage being valued at Sh 30,000.

He alongside eight others denied the charges and, through their lawyer Harry Gakinya, sought to be released on reasonable bond terms, urging the court uphold a previous bond they had secured before they took plea.

Principal Magistrate Bernard Mararo, in his ruling, agreed with the prosecution noting that the holding file has since been closed directing that the accused persons be released on a personal bond of Ksh.1 million, surety of the same amount or an alternative cash bail of Ksh.500,000 each.

The case  will be heard on February 14, 2019.
