Sonko’s hot soup for breaching the constitution on the conduct of state officers

Mr Kamau the owner of marble Arch Hotel, went to court accusing Mr Sonko of releasing a recording of a conversation in which he insulted the business man initiating social media attacks.

The High Court on Monday officially barred Nairobi Governor Mike Sonko from issuing defamatory content about the business man publications against him or his property. Justice Jean Kamau issued the order pending hearing of a suit, filed by the businessman.

In the case, Mr Kamau wants the Nairobi Governor compelled to pull down posts about him from his Facebook page, in which he claimed the businessman misled the court using forged documents.

The trader further wants Sonko declared as having acted in breach of Chapter Six of the Constitution on the conduct of State officers because he allegedly interfered with a process sanctioned by court order, which undermines the authority of the Judiciary.

The demolition in question was conducted by the tycoon on December 2017 in Kayole and left 11,000 families homeless.

The businessman says the recording, which was widely circulated, and the Facebook post were meant to depict him as someone who is violent, corrupt, and has misled the court using fake documents, a criminal offence under the Penal Code.

He is seeking general damages for libel, slander and loss of business.
