The Supreme Court on Friday declared Lamu Senator Anwar Loitiptip validly elected.
The apex court set aside the Court of Appeal ruling that had nullified his election.
The judges ruled that the Court of Appeal erred in law when they determined the matter without a proper notice of motion and also delving into matters of law.
Loitiptip lost his seat when the Court of Appeal determined that there irregularities in the August 8, 2017 poll.
Three judges in Mombasa said the IEBC did not clear the irregularities before declaring the winner.
