Revealed!Why DCJ Mwilu’s case is far from over

The case against deputy chief justice Philomena Mwilu has taken a new twist after Lawyers representing her  gave  their oral arguments to have Queen’s Counsel Khawar Qureshi, prohibited from prosecuting the Director of Public Prosecution’s case against their client.

The lawyers argued before the five judge bench appointed by Chief Justice David Maraga.

Mean while ,the court also heard arguments on the DPP’s application to have Senators James Orengo and Okongo Omogeni prohibited from representing Mwilu in the suit.

Justice Mwilu  is fighting off charges of:

  • Obtaining execution of a security belonging to Imperial Bank Limited by false present
  • Abusing her office for personal gain.
  • Accepting a gift in the form of money in circumstances which undermined public confidence in the integrity of her office.

  • Unlawful failure to pay taxes.
  • Conducting herself in disregard of the law.

Mwilu obtained High Court orders stopping her prosecution before the DPP asked the Chief Justice to set up an expanded bench to determine if she is immune from prosecution.
