The Law Society of Kenya has taken the Director of Public Prosecutions Noordin Haji to court over what it terms arbitrary arrest of its members who fail to divulge client information.
Also sued are DCI George Kinoti, Inspector General of Police Joseph Boinnet, Attorney General Paul Kihara and Chief Justice David Maraga.
The LSK said the state agents have interfered with the veil of privilege bestowed upon advocates by law and in turn exposed them to tremendous negative legal consequences.
The advocates Act allows lawyers to hold in confidence information given or disclosed by their clients.
But the LSK said, in a departure from the norm, state agencies have resorted to breaching that privilege.

The LSK is seeking orders to prohibit state agencies from arresting lawyers.
Meanwhile still in the corridors of justice,Retired General Twalib Abdallah Mbarak has been sworn in as the CEO and accounting officer of the Ethics and Anti-Corruption Commission (EACC), taking over from Halakhe Wako whose term expired last year.
AG Paul Kihara calmly urged the new EACC boss to stop ‘child fights’ with the DPP and DCI and instead work to deliver that which is expected of him.
On his part, EACC Chairman Eliud Wabukhala said “the war against corruption can and will only be won when all of us work together to eradicate it. Corruption affects all of us and more so the vulnerable in our society.”
