A Nairobi court on Friday ruled that firebrand politician Miguna Miguna is a Kenyan citizen saying his birthright cannot be changed.

In his ruling, Justice Chacha Mwita further awarded Miguna Ksh.7 million for what the court found to be violation of his human rights.

In March 2018, a team, comprising Interior CS Fred Matiang’i, National Intelligence Service director Philip Kameru, Inspector General of Police Joseph Boinett and Immigration PS Gordon Kihalangwa is understood to have concluded that allowing Miguna into the country on the strength of his national identity card was improper.

The security team then went and told the President that they had done everything possible to facilitate Miguna’s re-entry into the country, but the self-styled NRM ‘general’ had become a “nuisance with his insistence that he be allowed in on his terms”.

Uhuru met with the top security officials on to brief him on the controversial lawyer’s status and the action they intended to take, before they later forcibly deported him in mysterious circumstances.Image result for uhuru miguna

President Uhuru Kenyatta found himself in a dilema and told government officials dealing with Miguna Miguna to enforce the law while respecting the courts, effectively leaving his fate in their hands. It is then that Dr Miguna “was sedated, handcuffed and taken out of Kenya via a Dubai-bound EK722 flight and deported to Dubai.

On the night befor his deportation, police in full combat gear were alleged to have attacked journalists and lawyers who attempted to access Dr Miguna.

The lawyers had gone to the airport to serve court orders directing his release when they were roughed up.

Some sources claimed the exit Dr Miguna, the self-declared ‘general’ of the National Resistance Movement (NRM), a wing of the Nasa that was formed to champion resistance against products of firms deemed friendly and financiers of Jubilee government, was facilitated by Canada.

“Canada was strict on flying rules which he obeyed,” the source told the Nation.

Government officials claim Miguna was deported because he had denounced Kenyan citizenship.
Ministry of Interior spokesman Mwenda Njoka said Miguna renounced his Kenyan citizenship years back, acquired Canadian citizenship and never bothered to reclaim Kenyan citizenship in the legally prescribed manner, neither did he disclose that he had another country’s citizenship despite being a lawyer who should have known better.

The lawyer holds Canadian citizenship and has denied government claims that he acquired it after ceasing to be a Kenyan in 1998.

Dr Miguna, who ran for Nairobi governorship in Kenya’s August 8, 2017 General Election and has two homes, one in the capital and the other in Nyando, Kisumu County, insists he is a Kenyan by birth.
