Three criminal charges that led court to deny Mugo wa Wairimu bail

A quack is a “fraudulent or ignorant pretender to medical skill” or “a person who pretends, professionally or publicly, to have skill, knowledge, qualification or credentials they do not possess.

And that is what exactly Mugo wa Wairimu is a profession at.

Quack doctor James Mugo Ndichu alias Mugo wa Wairimu has been  denied bail pending trial by a Nairobi court.
The court ruled that the conditions of the bond terms alone can neither guarantee nor safeguard the integrity of the trial process.

“I find that compelling reasons have been provided by the prosecution and the application has merit,” Senior Principal Magistrate Martha Mutuku said.

Previously ,the prosecution who relied on an affidavit by George Oyier, an investigating officer in the case had added that Mugo is facing three other criminal charges and is being investigated for several other offences. “He is being investigated of unlawfully carrying on a pharmacy business while not registered as a pharmacist,operating a medical laboratory without registration and license, operating a medical clinic without registration and license and obtaining money by false pretenses,” said Oyier

According to the prosecution, Mugo Wa Wairimu has other four pending cases of similar nature and releasing him, would jeopardize the investigations.

Wairimu was denied bail and is to remain in police custody pending the trial.

He was arrested following an expose on NTV Kenya after weeks of evading arrest by continuously swapping SIM cards.

Detectives from the Flying Squad busted him in Kiambu barely a week after the investigative report aired on television.

His co-accused Victor Gathiru Kamunya, 22, and Risper Auma Ogony, 19, were previously arraigned at a Nairobi Court and also charged with several offences including operating a pharmacy illegally.

On November 20, they were released on bail as the court directed that they deposit bail of Ksh.200,000 or Ksh. 500,000 bond with surety of similar amount each.

Mugo had previously asked the court to reduce the number of days he was in custody saying they were too long  before being brought to court arguing he was disadvantaged as he did not have a legal representative.

Lawyer Cliff Ombeta refused to represent Mugo in the second case claiming that he fears facing backlash from women considering the quack’s criminal record.

“Being a man with a daughter, I do not want to be involved in this matter. I have managed to get him out on previous matters but now I have decided this matter is a little bit murky. I tend to also think the energy that I will receive is negative especially from ladies and women,” said Cliff Ombeta.
