Prosecution, Khawar Qureshi slaps back at the cold footed Orengo

The case involving DCJ Mwilu seems to be a tough battle between the countries top most brains and the UK based lawyer who is leading the prosecution side.

The case has already started picking momentum as the top brains continue to clash in the court each presenting different demands for the case before they can proceed further.

Lawyers representing Deputy CJ Philomena Mwilu in a petition seeking to determine whether she should face criminal charges have opposed a foreign counsel appointed by Kenya’s public prosecutor Noordin Haji.

Senior Counsel James Orengo on Thursday opposed Queen’s Counsel Khawar Qureshi from representing Mr Haji in the petition to be heard by five judges.

According to Mr Orengo, Prof Qureshi cannot represent Mr Haji in the case because he does not possess instruments such as certificate of admission allowing him to practice in Kenya.

But the prosecution side has also replied to Orengo claims saying that the DCI has the power to pick whatever lawyer he wants to represent him.

The decision to go for Khawar Qureshi was based on the fact that most Kenyan lawyers had a conflict of interest and that fairness and balanced was not granted.

The 5 bench court is set to reside and give the way forward before the case can proceed even further.
