Legislature ordered to pay Driver 40,000 monthly after sacking his driver

Weeks after firing his driver,  Milimani Law Court has ordered a legislature to pay  his driver Ksh40,000 monthly .

Senior Principal Magistrate Addah Obura nominated MP David Ole Sankok  to pay his driver KSh 40,000 salary every month for irregularly sacking him.

Sankok fired Raphael Kapaya on September 15 on grounds that he was drunk and disorderly.

The nominated MP to pay Kapaya half his Ksh80,000 salary after the sudden dismissal until the application he filed in protest against dismissal was heard and determined.

“I have ordered the defendant pays the complainant his half salary pending determination of this matter  I also order this matter be referred for arbitration as per clause 9 of the contract of employment between the parties,” the ruling read.

The legislator told the court Kapaya had assaulted him and broke his walking crutches hence could not continue working with him.

He further dismissed Kapaya’s plaint citing he notified the clerk of the National Assembly he had terminated his contract and replaced him with Nicodemus Konene through a letter dated Thursday, September 20.

“Following the dismissal of Kapaya as my driver I entered into a new contract with Konene as his replacement. I had to pay him using my own money,” he mentioned.

The driver alleged that Sankok had terminated his contract to replace him with his clansman as he had dished out personal assistant and secretary position to his wife and relatives.

He further stated that he neither assaulted the MP nor broke his crutches.
