Maribe vs. Prosecution. Journalist returns to court tomorrow

Reports from the Secretary of Innovation, Digital and Diaspora Communication in the Office of the President Dennis Itumbi, Citizen TV journalist Jacque Maribe is expected back in court tomorrow, 27th November.

According to Itumbi who is also a very close friend of Maribe, the prosecution has ever since her release last month neither provided her with witness statements nor access to her house to pick her clothes and those of her son, Zahari despite orders from the court.

 

“My friend Jacque Maribe is back in court tomorrow. Very sad that the prosecution has yet to provide her with witness statements or even access to her house to pick her clothes and those of her son. That is despite clear court orders last month,” said Itumbi in a tweet.

 

Jacque Maribe now wants Director of Public Prosecutions Noordin Haji and Directorate of Criminal Investigations George Kinoti found in contempt of court for failing to hand over her Langata rental house as directed by the court.

Maribe is also seeking release of her car which was impounded after police claimed her fiance Joseph Irungu alias Jowie used it on the night Monica Kimani was killed.

In an application filed through her lawyer Katwa Kigen, Maribe laments that despite a court order, the authorities are yet to return her phone, SIM and memory cards.

“Punishment(s) be meted out to the contemnors for their imprisonment for a period of up to six months and or a fine of Sh200,000 or otherwise as the court may deem fit, just and fair for the integrity of the court proceeding…” reads a section of her application.

Maribe also disclosed that the prosecution is yet to make any documents or materials likely to be used during the hearing of the case available.

She argues that the prosecution might have delayed in supply of document “because the materials show no culpable evidence against the applicant, yet they have maintained to the public the posture of being sterling having resolved the crime(s) at hand and having established culpable parties on an objective measure.”

“The materials will show the unjust malice against the Applicant in being charged for public spectacle than for the merits and any culpability in the case,” the application continues to read.

As a result, Maribe is now asking the court to disqualify the lead prosecutor Catherine Mwaniki from the case if found in contempt.

She further wants the court to award her “monetary compensation for delay to hand over the house as the court may deem just and fair.”

Jacque Maribe granted bail by Justice James Wakiaga freed her on a Ksh. 2 million surety bond with an alternative of a Ksh. 1 million tripartite surety cash bail after spending over one month in police custody in Lang’ata Women’s Prison.

Maribe is facing charges for the murder of business woman Monica Kimani who was found dead in her apartment on Dennis Pritt road in Nairobi’s Kilimani area.
