Mugo wa Wairimu pleads not guilty

Naiorbi’s quack doctor still has a few more night to spend in police custody after the court set his bail ruling for December 6th 2018.

James Mugo Ndichu alias Mugo wa Wairimu was arrested after a TV expose on NTV that revealed that he operating an illegal clinic and many other offences.

Mugo wa Wairimu, who appeared before Senior Principal Magistrate Martha Mutuku today denied charges of operating a clinic without a licence.

According to the charge sheet, Mugo is facing three other counts including carrying out unlawful business as a pharmacist without a license and operating a medical laboratory without a licence.

The quack doctor was found after weeks of evading arrest by continuously swapping SIM cards until finally an expose on his operations aired on NTV led police officers to his location.

Charges against him read that on November 3, at Milan Health International Limited, he was involved in carrying out the business of a laboratory without a licence from the Kenya Laboratory Technicians and Technologists Board. He was also charged with operating a clinic without a licence and engaging in private practice as a nurse while not licensed.

He pleaded not guilty and asked the court to release him on bail pending trial. The DCI’s George Oyier filed an affidavit to oppose the release of Mugo on grounds that the accused had similar offences pending in court and is also likely to interfere with ongoing investigations and witnesses.

According to Oyier, there are two cases pending in court where Mugo jumped bail. The state will file an application in the High Court to have the witnesses admitted under the witness protection agency.

However, Mugo’s Lawyer, Kepha Ojijo said Oyier’s application was baseless and is not grounded on law. Ojijo also said that Mugo was not aware of the witnesses in the case against him because Oyier has neither served him with their statements or disclosed the identity of such witnesses.

According to Oyier, his client has attended court in the only case where he was charged with similar charges in 2015 and the DCI did not avail compelling reasons to have the medic denied bail and bonds.

He said the application by Oyier to have Mugo remanded while two of his alleged workers were admitted to bond is prejudicial and suggests that he has already predetermined him a criminal.
