Court clears Lamu Politician

Garsen High Court has cleared   Rishad Amana to contest in future elections.

Amana was charged before Lamu magistrate Njeri Thuku in May. He was fined Sh110,000, being for obstruction and for creating disturbance.

The politician was barred from taking part in elections after he was found guilty of obstructing IEBC officers from conducting their duties but he  appealed the ruling.

However Lady Justice Roseline Korir said the High court did not find evidence that showed the politician committed the offences he was charged with.

The judge further ordered that Amana be refunded the fine he paid following the magistrate court’s ruling.

Amana vied for the Lamu West seat in August last year but lost to Stanley Muthama.

Accompanied by his lawyer Alfred Omwancha, the politician said the ruling now allows him to continue being active politics.

“The judgement is clear proof that I was innocent,” he told journalists.

A Lamu court had barred  the politician  from vying for any political post in the next five years.

Mr Amana, who vied for the Lamu West Parliamentary seat in the August 8 General Election but lost, was found guilty of assault and causing disturbance at the Mokowe Constituency tallying centre.

Lamu Resident Magistrate Njeri Thuku found Amana guilty of two counts of electoral malpractice. But Mr Amana has the liberty to appeal against the ruling.

And when he appeals, the law obliges the Electoral and Boundaries Commission (IEBC) to register such a candidate until the appeal is heard and determined.
