Why DPP Drops Case Against Machakos Governor Alfred Mutua

The DPP and EACC on Wednesday consented to drop the corruption case against Machakos Governor Alfred Mutua.

Reports stated that the two authorities signed an agreement at the Court of Appeal.

“This appeal be and is hereby marked as withdrawn in terms that EACC and DPP undertake not to institute any criminal charges against the appellant,” read the statement from the parties.

The consent was recorded before Judge Roslyn Nambuye, Judge Otieno Odek and Justice Asike Makhandia who had taken up the case as reported by the Star.

The bodies agreed that Mutua would not face any criminal charges.

The governor had been accused of illegal purchase of 16 vehicles in 2016 where one was for personal use.

Mutua had however refuted the claims and stated that the purchase of the vehicles was agreed and authorized by the Machakos County Assembly.

The politician had moved to the Court of Appeal to challenge the decision by the High Court that dismissed his petition which sought to block the prosecution who, he claimed, violated his rights.

At the High Court, Justice Isaac Lenaola had ruled that the Dr Mutua’s claim of misinformation lacked merit.

“The petitioner (Dr Mutua) literally jumped the gun because he has basically presented his defense of innocence in the trial court and not before the High Court, a mistake on his part,” stated Lenaola.
