A file in the murder case of Magistrate Carol Kemei’s daughter Maribel Kapolon on Monday went missing in a Chuka Court.

A case, in which two people have been accused of murdering the daughter of a magistrate failed to take off on due the missing file.

Mr Benson Kimathi, a former prison warder at Kangeta Prison and Mr Francis Otudo, have been accused of killing Maribel Kapolon, the daughter of Githongo Law Courts Senior Resident Magistrate Carol Kemei.

Kapolon was kidnapped on September 6 and her body found dumped in Gitoro Forest, Imenti North, 11 days later. The case was initially filed in Meru before it was transferred to Chuka.

Justice Robert Limo, who was to hear the case, said he had not seen the file.

It later emerged that the file was brought to Chuka on Monday but the High Court in Meru was yet to write to Meru GK Prison so the suspects can be taken to the High Court in Chuka.

The kidnappers had demanded Sh500,000 in release of the slain Magistrate’s daughter.

Barely a day ago another file into Kenya Power and Lightening Company (KPLC) cases went missing.

The Director of Public Prosectutions (DPP) Noordin Haji ordered for investigations into circumstances under which documents meant for prosecution of KPLC corruption cases went missing.

The office of the DPP has confirmed that the said documents were under the custody of KPLC.

Top KPLC managers including the immediate former MD Ken Tarus, his predecessor Ben Chumo and 12 others were charged with conspiracy to defraud the parastatal of over Ksh409 million.

They have been accused of procurement of defective transformers and the irregularities in prequalifying 525 companies for labour and transport contracts.

Through the two contracts, for transformers and labour and transport, Kenyans lost Sh470 million besides the inconvenience the defective transformers have caused.

Dr Chumo and three directors of Muwa Trading Company Limited, which supplied the defective transformers, were charged with three offences of conspiracy to defraud contrary to Section 317 of the Penal Code, conspiracy to commit an offence of economic crime contrary to Section 47 A(3) as read with Section 48 of the Anti-Corruption and Economic Crimes Act 2003 and fraudulent acquisition of public property contrary to Section 45(1)(a) as read with Section 48 of the Anti-Corruption and Economic Crimes Act 2003.
