It was alleged that instead of accepting free property from the government of Japan for the embassy, 1.6 billion shillings was withheld from the sale of Kenyan property in Nigeria and used to buy a less suitable property.

They were charged with abuse of office in procuring the embassy and ambassador’s residence in Tokyo at a price of Sh1.4 billion, and for failing to involve the ministerial tender committee in approving the purchase.

The trio authorized the purchase of a building for an embassy and ambassador’s residence while “aware that a fair market price could have been obtained had proper procurement procedures been adhered to”, Kenya police documents said.

The deal was controversial in Kenya where the United Nations says around 45 percent of the population lives in poverty, and where graft and corruption are endemic.

Outgoing President Mwai Kibaki promised to crack down on corruption after he was elected in 2002 but no minister has been convicted of graft in Kenya.

Now Moses Wetangula is probed over the leaked telephone conversation and a representative of the Dubai royal family over the fake gold scandal that has hit the country.

In the audio, which is doing rounds on social media, a man is heard mentioning names of President Uhuru Kenyatta and Opposition leader Raila Odinga to assure a Dubai gold investor that their detained consignment would be released.
