EACC: Gov Kasaine has violated bail terms

The Ethics and Anti-Corruption Commission has revealed that Samburu Governor Moses Kasaine was cited violating his bail terms.

This is because the governor accessed his office and reshuffled eight Cabinet Secretaries via gazette notice of 18th April 2019.

The court heard that between March 27, 2013, and March 25, 2019, at Maralal Town within Samburu County, the governor, his deputy, county secretary, chief officers and head of a supply chain respectively conspired to defraud the county of Sh84 million.

Mr. Kasainie is charged with conspiring to commit the offense of corruption, which led to the unlawful payment of Sh84,695,996 to his petrol station known as Oryx Service Station.

The prosecution through Alexander Muteti told the court that stringent conditions should be issued to the accused given the magnitude of the charges facing them.

He was ordered to deposit an Sh100 million cash bail to secure his release pending trial in a corruption case.

Anti-Corruption Chief Magistrate Douglas Ogoti ruled that in the alternative, Kasaine can post a bond of Sh150 million plus one similar surety.

The High Court then reduced stringent bail terms imposed on Samburu Governor Moses Kasaine from Sh100 million cash to Sh10mn.

Justice Mumbi Ngugi directed the governor to deposit and alternative bond of Sh30 million with a surety of similar amount to secure his freedom from custody.

She, however, ruled that the remaining orders of the trial court shall remain in force pending hearing and determination of a petition by the Director of Public Prosecutions as directed by the trial court.

β€œThe applicant has been barred from accessing county offices, so the apprehension that he may interfere with witnesses is not a consideration,” she ruled
