How University Student ‘Killer’ Will Defeat Case!

Chances are Naftali Kinuthia could walk free out of police custody based on certain lee-ways the Kenyan Constitution provides.

Naftali who is reported to have traveled to Eldoret from Nairobi and murdered her girlfriend Ivy Wangeci in cold-blood has a couple of ways to actually get away with murder.

Appearing before an Eldoret Magistrate Monday, Kinuthia was a composed man despite the injuries he sustained in the hands of a mob.

He could be seen occasionally exchanging nuptials from his lawyer who argued Kinuthia’s case to a full-to-the-brim court.

Based on the haphazard manner in which police handled the suspected exhibit found at the crime scene, investigators may find absolutely nothing that links Kinuthia to the death.

With improper handling of critical leads, the judge handling the case is likely to throw it out based on the lack of evidence.

The other way Kinuthia could walk freely out of detention is through a mental examination process.

If the results of the sanity tests reveal that indeed Kinuthia is of unsound mind, the courts will exonerate him from further prosecution.

In fact, he will have no case to answer!

In between, there are several loopholes that Kinuthia’s lawyer could exploit to gain a favorable court ruling should he be found guilty.

His lawyers are Mbiyu Kamau and Rachael Mbebe.

Ruling on the case Monday, Eldoret Magistrate Nicodemus Moseti said Kinuthia will be allowed back to the Moi Teaching and Referral Hospital on the 18th and 23rd of April, before the hearing of the case begins on April 30.

Kinuthia had been admitted for four days after police rescued him from an irate mob baying for his blood.

During the four days at the High Dependency Unit, doctors monitoring him said his condition was critically unstable due to the risky fractures he had sustained on the head.

Appearing Monday at the Eldoret court, Kinuthia had multiple visible injuries both on his hands and face. He also had stitches allover his body.

Meanwhile, police will have 15 more days beginning Monday 15 to detain the murder suspect.
