Ezekiel Mutua opposes Wanuri’s move to have court film “Rafiki”

The Kenya Film Classification Board (KFCB) boss Ezekiel Mutua has opposed Wanuri’s application to the court to watch her Rafiki film before making the ruling.

According to Mr Mutua it is not necessary for the court to watch the film for them to determoine their ruling.

His statement came after Wanuri the director of the film wrote to the Deputy Registrar of the Constitutional Court through her lawyer Mugeria, Lempaa and Kariuki advocates requesting for audiovisual equipment to enable the court to play the film during the hearing.

“The Evidence Act lays down the conditions which must be met before electronic records can be declared admissible. Petitioners have not satisfied any of the conditions stipulated by the Evidence Act in relation to production of electronic records as evidence before the court. The film we assume shall be presented in some electronic format for exhibition before court,” he Mutua said.

The fight between KFCB and Wanuri started after her film was banned with Mutua claiming it was not according to the standards for the Kenyan films.

However Wanuri has been contesting the constitutionality of the ban on grounds that it is a violation of freedom of expression.

She wants the court to determine whether banning the film was a violation of her rights under the Constitution.
