“Toka Kwa Ofisi” Maraga in ‘Hot Soup’ After Angry Kenyan Files Suit to Have Him Removed From Office

A man by the name Yussuf Ibrahim Dimbil filed a fresh petition on Thursday, seeking the removal of Chief Justice David Maraga from office.

The man filed the petition at the Judicial Service Commission (JSC), citing gross violation of the Constitution by the Chief Justice.

Ibrahim went ahead to list a number of offenses that he believes were sufficient to oust Maraga from the public office.

He accused Maraga of attending political rallies, employing people from one ethnic group to the judiciary and making utterances that are unconstitutional.

The man added that in some instances, the Chief Justice had made reckless political statements without caring about the Independence of the Judiciary.

Ibrahim added that Maraga presided over the presidential election petition with a relative as one of the lawyers in the matter.

“Brian Onderi, who was on the record together with other advocates for the petitioner, is the nephew of the Chief Justice,” he wrote.

“Despite having full knowledge of this fact, the Chief Justice went ahead to hear and determine the petition whereas the basis of this simple fact, bias both in fact and appearance would, to any reasonable person arise,” read part of the petition.

There was controversy in late February after Maraga welcomed President Uhuru Kenyatta in Kisii during the launch of the Ksh2.2 billion Cancer Diagnostic and Treatment Center.

He was in the company of Deputy President William Ruto and Opposition leader Raila Odinga with a section of Kenyans raising concern that his political friendship with the regime would hurt the independence and autonomy of his office.
