Mithika Linturi has been dealt a blow yet again after a court ruled that his estranged wife Maryanne Kitany should not be evicted from their Runda home.
This means that she will remain in the home until the divorce case is heard and determined, according to the court ruling.
The area Officer Commanding Police Station (OCS) was also directed to ensure that the orders are complied with.
Earlier, Linturi’s lawyer had requested that the court stay the ruling, adding that he would lodge an appeal against Friday’s decision within 30 days.
Advocate Danstan Omari, for Kitany, however responded saying that a formal application for stay must be made.
…the ruling today (Friday) changes nothing to earlier orders made by this court .. staying the orders will mean that my client gets out of the home,” Omari said.
The court declined to stay the ruling and directed Linturi to file a formal application for consideration.
