DPP to work closely with the Judiciary to root out crime

DPP’s Press Statement on the Communique from the meeting of the Hon Chief Justice of the Republic of Kenya with the judiciary leadership

The ODPP wholeheartedly salutes and welcomes this afternoon’s communique issued by the leadership of the Judiciary, under the chairmanship of the Hon. Chief Justice and President of the Supreme Court David K. Maraga, acknowledging that the war against corruption can only be won by a fervent inter-agency co-operation. To that principle of inter-agency cooperation and collaboration the ODPP fully subscribes.

We particularly thank the leadership of the Judiciary for having re-confirmed their commitment to the respect for the operational and institutional independence of the ODPP in the context of management of prosecutions.

Coming, as it does at a time in the history of our country when we sorely need to collectively address the all-important question of eradicating corruption and other terms of organized crime as a crucial subset of the rule of law, administration of justice and the protection of the rights and liberties of all, the commitment is a salient step in the right direction.

Further, we commend the Judiciary for acknowledging some of the challenges faced by the prosecutorial arm, such as the provision of witness statements which often run into thousands of pages in anti-corruption cases.

It is our hope, going forward,that all criminal justice actors shall, in the renewed spirit of collaboration and cooperation adopt the most practical and innovative way of ensuring that such evidential material is supplied to the accused persons expeditiously and at minimal cost.

To this end, the ODPP shall strongly advocate for use of technology in investigation,  and adjudication without compromising the right to a fair trial.

On our part, in collaboration with the investigative agencies, we shall endeavour to have criminal cases robustly and speedily prosecuted while upholding the Rights of all parties concerned.

We look forward to a closer working relationship with the Judiciary whilst respecting and protecting each other’s Constitutional and Statutory mandate
