In un expected move,Meru Senator Mithika Linturi is now claiming that his estranged wife Marianne Kitany forged the alleged papers showing that he divorced his wife.

Documents presented in court showed that the said divorce registered under No. 128 of 2005 was between Elizabeth Ann Patricia Hennessy vs. Parrie Andrew Hennessy and not Franklin Mithika Vs. Mercy Kaimenyi.

“The entry in the Register shows that it is a concluded matter and we have confirmed from Kenya Law Reports that the judgement is reported as E.A.P.H v. P.A.H (2011 ),” reads a letter from the deputy registrar.

The registrar has further asked for more time to conduct a search for the original file.

The said letter was a response to a letter that had been written by Linturi’s lawyer dated December 28, 2018 seeking to confirm the genuineness of the divorce petition filed at the Meru Law Courts.

Linturi has denied having any matrimonial ties with estranged ‘wife’ Maryanne Kitany.

“I am in a monogamous relationship with only one woman, who is not Kitany,” he argued through lawyer Muthomi Thiankolu.

The lawmaker says he only allowed Kitany to stay as a visitor and “that’s why she was evicted when she claimed that she is married.”

The matter is expected to be heard on Tuesday, January 15.

The two have filed several cases at the courts including a divorce petition with the court restraining the legislator from evicting Kitany from their Runda house.

Court orders have since been issued for preservation of properties jointly owned by Linturi and Marianne Kitany, pending the determination of a case she has filed.
