Kenya’s senior council ends the year in style!

Senior Counsel, Tom Ojienda, ends the year in bad terms after he was arrested on Friday afternoon at an undisclosed location in Nairobi, and taken to the DCI headquarters on Kiambu Road.

Elsewhere, the officers, drawn from the Special Crimes Prevention Unit and Flying Squad, were also in search for a High Court judge.

According to sources, Ojienda is likely to be locked up the entire weekend and presented in court on Monday.

The prosecution plans to question Ojienda and the judge over a Sh200 million audit at the Mumias Sugar Company.

Sources have also claimed that DCI chief,George Kinoti  was personally supervising the operation to arrest Ojienda and other suspects.

It is reported that DPP,Noordin Haji approved Ojienda’s arrest after receiving the investigation files on the matter last week.

This comes after a special team of investigators comprising officers from the DCI legal department and the ODPP had been investigating the suspected loss of Sh200 million from the sugar company.

Nevertheless, the arrests come in the wake of a protracted court battle between Ojienda and the Kenya Revenue Authority  over tax compliance.

The Directorate of Criminal Investigations and the KRA had been prohibited from arresting or questioning lawyer Tom Ojienda over alleged unpaid taxes for 2009-16.

Ojienda had filed the case early in November, seeking to stop his arrest, claiming that the KRA was being used to fight political battles, aimed at sabotaging his race to be voted as the lawyers’ representative at the Judicial Service Commission (JSC).

“It is apparent the respondents are out on a malicious excursion to ‘get me’ and to ensure that I’m subjected to a flawed criminal process smeared with illegalities, bad faith and witch-hunt with the sole intention of irredeemably tainting my reputation in the eyes of the public and lawyers,” he claimed.
