The High Court on Monday restrained Meru Senator Mithika Linturi from transferring property that he owns with his estranged wife, Marianne Jebet Keitanny.
The court, while stating that a ruling would be delivered on Monday next week, further granted Ms. Keitanny access to their home in Runda for the purpose of picking her children’s belonging.
Ms. Keitanny had moved to court to claim Ksh.10 million she alleged to have lost during the December 19, 2018, scuffle at their Runda home which led to her eviction.
While seeking a court order to allow her back to her home, she said she currently does not have a place to call home and that her children who will soon resume school have no books or any other items.
According to a document before court, the two were married under Meru customary laws after both parties had divorced from their previous marriages.
The court heard that, together, they have registered several companies, acquired assets together and that Ms. Keitanny had been performing her duties as a wife.
In his ruling, Milimani Commercial Court Senior Resident Magistrate I. Orenge granted exclusive occupation of the besieged couple’s shared residence to her.
He further barred the politician from loitering near the home or any other place where his wife frequents.
According to Magistrate Orenge’s interim order, the Senator was restrained “from physically or sexually abusing or threatening to abuse the Applicant, the Applicant’s staff, their six children and/or any other person associated with the Applicant.”
