The case against the Deputy Chief Justice Philomena Mwilu has attracted numerous reactions from the heavy weights in law.
The first appearance by UK based lawyer , Queen’s Counsel Qureshi Khawar was received by a lot of opposition by Kenyan Lawyers on DCJ Mwilu’s side.
Senior counsel James Orengo said that UK Lawyer is not valid to represent the office of the Prosecution handling the case against DCJ Mwilu. In his argument he urged that Qureshi lacks certificate of admission from the judiciary.
This made the court to go to a recess for the five bench judges to rule on the matter after Orengo among other lawyers defending Mwilu to file a formal application to their demand.
Senator Kipchumba Murkomen has joined Orengo in opposing the UK based lawyer Khawar Qureshi. Kipchumba Murkomen in his argument says that after independence the country should not be going for foreign lawyers.
According to Senator Kipchumba Murkomen he claims that DPP Noordin Haji should lead by example and take up the case against DCJ Mwilu in the fraud case.
The idea of getting a foreign Advocate to prosecute domestic cases just before our Independence Day is totally misguided. If the DPP mistrusts all the Kenyan Lawyers he should just have led by example and prosecute the case himself.

But in reply, secretary of prosecutions Dorcas Oduor said the Mr Haji has a right to pick a lawyer of his choice to represent him in any case.

Ms Oduor said they will be happy to respond to opposition by Mr Orengo if the defence team makes a formal application.
Due to this application the case is set to be heard in January.
