The Court has finally come to the defense of Citizen TV journalist Jacque Maribe as it has today ordered that she be given access to her house. According to Maribe, the court has denied her access to her house to collect her clothes and those of her son despite court orders.

The Citizen TV journalist complained that she has had to “beg for clothes” after the prosecution disallowed her from picking her personal belongings from her home which is being treated as a crime scene.

This comes after the journalist through her lawyer, Katwa Kigen filed a fresh application seeking the court to have Director of Public Prosecutions Noordin Haji and Directorate of Criminal Investigations George Kinoti in contempt of failing to hand over her Lang’ata rental house as the court had earlier directed.

From today, Maribe will have access to her house with immediate effect after the court session. In her application, Maribe also sought to have her car, a Toyota Allion, her black iPhone and all the documents the prosecution intends to use in her trial over the murder of businesswoman Monica Kimani handed over to her.

However, Prosecutor Catherine Mwaniki today said that her phone is an exhibit in the case and will only be released once it is produced in court. In regards to her car, the prosecution said that it was awaiting a government chemist report.

“…we are waiting for a report from the government chemist which is not ready on whether they should release it or use it as an exhibit,” Ms Mwaniki told the court.

Maribe’s car was impounded after police discovered that it was used by her fiancé Joseph Irungu alias Jowie on the night Monica Kimani was murdered. Her car was dusted for fingerprints that could help in the murder investigations.

Maribe was released on September 31 on a Ksh. 2 million bond after spending a little over a month in police custody at Lang’ata Women’s Prison. Her fiancé Jowie was however denied bail by Justice James Wakiaga and is currently in police remand at Kamiti Maximum Prison.

Do you think the Prosecutor, Ms. Mwaniki should be disqualified from this case?
