Motorists crying over arrests for not having fire extinguisher

The corridors of justice keeps creating space for new criminals in reforms being introduced that aim to straighten our nation.

Contrary to a notice issued by the National Police Service (NPS) on which vehicles should strictly have fire extinguishers and first aid kits, another motorist has been arrested over the same.

A private motorist, Keval Shah, on Saturday, November 24, took to social media to express his disappointment after he was booked to appear in court for lack of the two.

According to the notice issued to Shah, he is to appear at Kibera courts on Monday, November 26, for driving vehicle with registration number KBB 574J without an extinguisher.

Shah was arrested by Dagoreti Police who impounded his car along Waiyaki way on the afternoon of Saturday.

The motorist claimed to have explained only Public Service Vehicles (PSVs) were strictly required to have the facility according to the notice by the NPS but the officers ignored him.

His arrest comes barely days after there was public uproar when another motorist was arrested in Murang’a county for lacking the said safety equipments despite the notice.

In the notice by NPS, only PSVs are required to have the safety equipment, particularly the ones which travel long distances. Traffic Police Commandant Samuel Kimaru had earlier on elaborated police who fined private motorists for lacking such facilities were doing so illegally.

According to Chapter 403 of the traffic act subsidiary legislation, a personal car could have the safety tools in case of a fire or accident, but it was only compulsory for PSVs. “Every motor Omnibus or matatu shall carry an efficient fire extinguisher which shall be maintained in perfect order and shall be carried in such a position as to be readily available for use at any given time,” reads the act.

“Every matatu which operates outside the limits of its municipality shall carry a first aid outfit sufficient to deal with any reasonable emergency. Such an outfit shall always be kept in first class condition,”
