Not having a House Will Make You a Guest of the State, Case of Jowie

 

The Monica Kimani murder case has made headlines for over a month now with various revelations made during the court sittings. This has mainly been attributed to the fact that a top TV journalist and her fiance were involved.

Today, the two were back in court. One left smiling while the other was clearly devastated at the court’s decision to deny him bail.

Maribe was freed on a cash bail of Ksh. 1 million with three sureties of a similar amount or Ksh. 2 million bond with one surety of a similar amount.

In his ruling, Justice James Wakiaga indicated that there was no indication that she is a flight risk and Prosecution did not prove that she would interfere with witnesses.

His co-accused Joseph Irungu was however denied bail with this seemigly raising eyebrows among the many Kenyans that have closely been monitoring the case.

The judge presiding over the case; Justice Wakiaga gave reasons as to why he denied Jowie bail and among them was the fact that Mr. Irungu had no permanent physical address other than Maribe’s house and hence it would be difficult for the state to monitor him.

The court noted that Jowie had no fixed aboard and no evidence before court that if released he would have a place to live so likely to abscond court.

Justice Wakiaga further indicated that his access to firearms and his already displayed love for guns could create fear and intimidation among the witnesses.

If released, the court ruled, there is a likelihood that he would interfere with the crime scene.

The court further ruled that having extensively traveled to Middle East with no known assets in the country, his willingness to surrender the passport is no guarantee that he will not jump bail or abscond court.

Irungu has been in custody since his arrest on the September 25,2018. He has charged alongside Jacque Maribe with the gruesome murder of Monica Kimani.
