The Office of Director of Public Prosecutions, through Mr Maxwell Otieno (the investigating officer), filled a miscellaneous application seeking more time to investigate Mr Odhiambo.

In his supporting affidavit, Mr Otieno says the suspect should be detained at an appropriate police station in Nairobi as he completes the investigation.

“Reason being that the suspect needs to be subjected to identification parade, which has yet not been done. The suspect, who indicated to the investigation team that he has crucial reports on the murder, should also be put under the protection unit investigating the case. It will take a corrective of more than 10 days to assess the reports,” the affidavit says.

In Maribe’s own words detailing the events of the day at her house when Monica was murdered she claimed:

He came crying: He started removing his clothes. By this time I had got into bed. When he came back in the room he was crying, telling me he was sorry and that he loves me.

I told him my child was sleeping and that he should stop making noise lest he wakes the child from sleep. He kept crying, saying “Jacque I am sorry”, but I ignored him.

He then went to the walk-in closet. I heard what sounded like a gunshot. I jumped out of bed and went to the closet, and he was lying on the floor. He had blood on his upper left chest area.

He was repeatedly saying: “I love you. I am sorry.” I panicked and ran back into my bedroom for my phone. When I turned back to the closet area he was not there. I saw through the window that he had gone to our neighbour, Mr Bryan Kassaine.

I ran out and found Joseph Kuria Irungu lying down. Bryan Kassaine had come outside.Bryan’s wife Cate also ran outside to where Joseph was lying. He was still bleeding from the chest.

Jacque was seeking bail prior to the arrest of officer Odhiambo however now the case might take a new turn.
